Practice Areas
I work with US counsel, companies, funds and importers on matters that need work done in India. The work falls into four groups. The fourth covers Indian regulatory and enforcement matters that also affect US companies.
A
Evidence, Discovery & Testimony
Testifying and consulting opinions on Indian law for US courts, arbitration, and agencies, from a lawyer admitted in both California and India.
Collection, review, certification and production of electronic evidence held in India, for use in US discovery and in Indian courts.
Applications to a US federal court under 28 U.S.C. § 1782 for documents and testimony held in the US, for use in proceedings in India.
B
Diligence & Investigations
Integrity due diligence on the founders, promoters and target of an Indian deal, within the deal timetable and under a Kovel letter from US counsel.
Third-party, vendor and supplier vetting in India for US compliance teams, with a lawyer checking in person when a screen raises a concern.
Country-of-origin and forced-labor tracing in India for US importers, prepared as evidence for US Customs and Border Protection.
C
Disputes, Recovery & Defense
Asset tracing and evidence in India for US and international law firms, to support freezing applications and the enforcement of judgments and awards.
Collectability diligence for funders before they commit: what the respondent holds in India, and whether a judgment or award can be enforced there.
Separate counsel for executives in DOJ and SEC investigations under the Foreign Corrupt Practices Act, coordinated with any parallel inquiry in India.
Voluntary disclosure, root-cause investigation and remediation of corruption risk in India, coordinated across US enforcement and Indian law.
D
India Regulatory & Enforcement
Matters before Indian regulators and enforcement agencies that also affect US companies, for example a US-listed parent with an Indian subsidiary, a multinational caught in a sector-wide inquiry, or a recovery that leads into US or UK proceedings.
Investigations for boards and audit committees under the Companies Act, 2013 and SEBI rules, including at Indian subsidiaries of US-listed groups.
Dawn-raid response and evidence review in Competition Commission of India investigations, for companies caught in a sector-wide raid.
Evidence for avoidance applications before the National Company Law Tribunal, including cross-border tracing and letters rogatory.
